CONDITIONS

PARTICIPATION

  1. This promotion ("Promotion") is conducted by Pepsico Australia Holdings Pty Limited, ABN 25 079 719 743, of 799 Pacific Highway, Chatswood, NSW 2067 ("Promoter").
  2. Entry to the Promotion constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
  3. The Promotion is only open to "Eligible Entrants", being individuals who: (i) are residents of Victoria or Tasmania; and (ii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.
  4. The Promotion comprises a total of 9 competitions (each a "Competition") made up of:
    1. 8 Competitions relating to the Melbourne Storm football club (each a "Club Competition"); and
    2. a Grand Prize competition (the "Grand Prize Competition").
  5. First entry commences at 12:00 hrs on 11/04/2008 and last entry closes at 24:00 hrs on 28/8/08 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. All times are stated using the 24 hour clock. 00:00 hrs is the start of a day and 24:00 hrs is the end of the day.

ENTRY TO A CLUB COMPETITION

  1. The Club Competitions may be entered at www.reactiontest.com.au/storm (the "Competition Website").
  2. Entry can only be made through the internet. To enter a Club Competition, an entrant must use a compatible browser to visit the Competition Website and follow the directions there to:
    1. in one session, play one of each of three on-line Club Competition games and achieve a minimum total game score of 6,000 points; and
    2. provide all the details requested at that Competition Website, including the entrant's first and last names, street address and e-mail address.
  3. Subject to the other conditions, an Eligible Entrant may enter any or all of the Club Competitions an unlimited number of times.
  4. All entrants must ensure that their Club Competition entries are received by the Promoter during the entry period for that Club Competition (see condition 17 below). The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any telecommunications service or equipment.

ENTRY TO THE GRAND PRIZE COMPETITION

  1. All entries received into all the Club Competitions will automatically be included in the Grand Prize Competition.

ENTRY GENERALLY

  1. Any costs associated with accessing a Club Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
  2. Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
  3. All entries may be subject to verification by the Promoter. An entrant MUST, within 7 days of being asked, at the Promoter's cost allow the Promoter to inspect and copy any documents the Promoter may request establishing eligibility to enter or win, including evidence of residence or identity.
  4. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter a Competition to the Promoter's satisfaction; or (ii) tampers with the entry process or benefits from such tampering; or (iv) submits an entry which in the Promoter's opinion is not in accordance with these conditions.

CLUB COMPETITION ENTRY PERIODS AND DRAWS

  1. The Club Competitions, and the entry commencement and close dates for each of those Club Competitions, are specified in the table in condition 17. Each entry into a Club Competition that is received during any of the entry periods for that Club Competition will be allocated to the draw for that period. An entry received exactly at the time any entry period commences will be allocated to the entry period that is just commencing (and not the entry period that has just ended).
  2. In each Club Competition: (i) entry commences at 00:00 hrs on the specified entry commencement date (except in the first Club Competition in which entry commences at 12:00 hrs); (ii) entry closes at 24:00 hrs on the specified entry close date; and (iii) the draw will take place at 11.15am on the specified draw date at Unit 10, 20-28 Ricketty St, Mascot NSW 2020.

CLUB COMPETITION PRIZES

  1. The Prizes to be won in each Club Competition are specified in the table in condition 19. Each prize listed by a date range followed by the names of two Clubs comprises two tickets to the match to be played between the named Clubs during the specified date range. Each ticket winner is responsible for all costs incurred in attending the match venue, including transportation, food and beverages.

  1. Where the table in condition 19 indicates that there are two prizes to be won in a Club Competition, the entrants who submitted the first two valid entries drawn in the Club Competition draw for those prizes will each win one of those prizes.

GRAND PRIZE DRAW AND PRIZE

  1. The draw in the Grand Prize Competition will be held at 4pm on 29/8/08 at Unit 10, 20-28 Ricketty St, Mascot NSW 2020.
  2. The Eligible Entrant who submitted the first valid entry drawn will win a "meet and greet" with a selection of members of the Melborne Storm football club ("Meet and Greet") and an NRL Team jersey signed by members of the Melborne Storm football club, together valued at $300 (the "Grand Prize Competition Prize"). More details of the Grand Prize Competition Prize are set out below.
  3. The Meet and Greet is for the winner and a friend of the winner's choosing, and will take place no later than 2009 at a time date and place of the Promoter's choosing. The Grand Prize Competition Prize winner is responsible for all costs incurred in attending Meet and Greet, including transporation.

PRIZES GENERALLY

  1. The maximum total value of all prizes is $940.
  2. All prizes are valued as at 26/03/08. The Promoter takes no responsibility for any variations in prize values.
  3. If any prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Promotion. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if any prize (or part of a prize) is unavailable for any reason.
  4. If a match for which prize tickets are awarded in a Club Competition is re-scheduled, moved to a different venue or cancelled, and the awarded tickets do not permit access to the match as re-scheduled or moved, or to an alternative match, the Promoter will use its best endeavours to provide tickets to the winner that permit access to an alternative match that is being played by the Melbourne Storm.
  5. Rights to receive prizes are not transferable or exchangeable and cannot be taken as a monetary payment, except as expressly provided by this condition 26. Subject to the written consent of the Promoter (which will not be unreasonably withheld a winner may transfer their prize to another person, provided that the transferee agrees to comply with these conditions. If an Eligible Entrant wishes to transfer their prize, the Promoter must first receive, a written request to transfer.
  6. Unless expressly stated in these conditions, a winner is responsible for all expenses incurred in relation to the enjoyment of their prize, including transportation to and from the ticketed NRL match, all food and beverages and any accommodation. 28.
  7. A winner will forfeit their prize (or any relevant part of it) if, for any reason whatsoever, the winner fails to attend their ticketed NRL match (or any part of it) at the time at which it takes place.

WINNERS

  1. Each winner will be notified in writing sent by e-mail to the e-mail address indicated in the entry. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
  2. The name of the winner of the Grand Prize Competition will be published on the Competition Website within 7 days of the prize being won (including in a redraw under condition 31), for a period of at least 1 week.
  3. Subject, where relevant, to any directions given under the legislation regulating the Promotion:
    1. if any Club Competition tickets prize: (a) is not claimed by a winner by 5pm on the Tuesday following the draw for that prize; or (b) is claimed but then forfeited for any reason, the prize will be awarded to another Eligible Entrant in a redraw for that prize commencing at 11.05am on the immediately following Wednesday, at Unit 10, 20-28 Ricketty St, Mascot NSW 2020.
    2. if the Grand Prize Competition Prize: (a) is not claimed by its winner by 5pm 15/9/08; or (b) is claimed but then forfeited for any reason, the Grand Prize Competition Prize will be awarded to another Eligible Entrant in a redraw for that prize commencing at 11.30am on 17/9/08 at Unit 10, 20-28 Ricketty St, Mascot NSW 2020.
  4. In order to be entitled to any prize, the winner must, if requested by the Promoter, agree to and sign:
    1. an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize; and
    2. a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
    If a winner is under 18 years of age, the winner must ensure that his/her parent or guardian agrees to and signs the documents referred to above (if requested by the Promoter). A winner who does not comply with this condition forfeits their prize.

GENERAL

  1. If for any reason the conduct or operation of any Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
  2. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; and (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
  3. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
  4. All of the Promoter's decisions are final and no correspondence will be entered into.
  5. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in a Competition. Entrants should obtain independent tax and financial advice.
  6. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with a Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
  7. Each winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting the Promotion, the Promoter and/or any of the Promoter's products.
  8. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition entered and publicise its winner(s) and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
